Answer and Counterclaim in Summary Procedure in International Arbitration


Upon receipt of a notice of arbitration and other documents, the respondent shall submit an answer and a statement of counterclaim, if any, accompanied by the necessary documents and other evidence, within the time period specified under the arbitration rules, e.g., 20 days under the arbitration rules of CIETAC and SHIAC, 10 days under the arbitration rules of CIA and SHIAC FTZ.

Upon receipt of the respondent’s counterclaim, the claimant shall submit an answer to the respondent’s counterclaim within the time period specified under the arbitration rules, e.g., 20 days under the arbitration rules of CIETAC and SHIAC, 10 days under the arbitration rules of CIA and SHIAC FTZ.


The disputing parties may request extensions of the above time periods by submitting a request for submission with good cause shown. Such a request shall be subject to approval by the arbitral tribunal or by the arbitration commission before the composition of an arbitral tribunal.
