Notice of Hearing in Summary Procedure in International Arbitration


Sometimes, a different time period for the service of notice of hearing is specified under the arbitration rules in the case of summary procedure. For example, 7 days under the arbitration rules of SHIAC and SCIA, 10 days under the SHIAC FTZ Arbitration Rules, 15 days under the CIETAC Arbitration Rules, etc., before the first hearing.


A hearing may also be postponed by the arbitral tribunal on its own initiative where it deems it necessary or at the request of a disputing party or joint request of both disputing parties and upon approval of the arbitral tribunal. For example, the time period for submitting a request for postponement is 3 days under the CIETAC and SCIA Arbitration Rules, 5 days under the SHIAC and SHIAC FTZ Arbitration Rules, upon receipt of the notice of hearing.


A notice of a subsequent or postponed hearing may not be subject to the above time periods.
