Suspension of the Arbitration Proceedings

Where it deems it necessary, the arbitral tribunal, or the chairman of the arbitration commission before the composition of an arbitral tribunal, may decide to suspend the arbitration proceedings on its own initiative or at the request of either party or joint request of both parties.

After the termination of the cause for the necessity for such suspension, the arbitration proceedings should continue in a timely manner.

Any such suspension should be excluded in the calculation of time periods specified under arbitration rules in accordance with the applicable provisions of the Civil Procedure Law of the People’s Republic of China pertaining to statute of limitations.
