Time Period for Rendering an Award in International Arbitration

Time Period for Rendering an Award in International Arbitration

An arbitral tribunal shall render an arbitration award the time period specified in the applicable arbitration rules. In the case of international arbitration, the time period for rendering an award is 6 months from the date of composition or appointment of the arbitral tribunal in accordance with the arbitration rules of CIETAC, SHIAC, SCIA, SHIAC FTZ, etc. If summary or expedited procedure is applied, such time period may be shorter. For example, SCIA Arbitration Rules specify a period of 2 months from the date on which the arbitral tribunal is formed in the case of expedited procedure.

Where the arbitral tribunal deems it necessary, it may request the arbitration commission to extend the time period for rendering an award under special circumstances or with good cause shown.

The following time periods shall be excluded in calculating the time period for rendering an award: any suspension of the arbitration proceedings, or any period for seeking expert opinion or appraisal report or conducting audit, evaluation, test, settlement, negotiation, mediation, conciliation, etc., as provided for in different arbitration rules.
