After a request for arbitration is accepted by the arbitration commission agreed upon by the disputing parties, the arbitration commission will establish an arbitral tribunal to hear the case and render an arbitration award. Arbitral tribunal is a temporary panel composed of a sole arbitrator or three arbitrators established for a specific case. According to the PRC laws, an arbitral tribunal may consist of: (1) a sole arbitrator; or (2) three arbitrators, including a chief arbitrator (also called presiding arbitrator or umpire).
An arbitral tribunal should be composed of three arbitrators unless the parties agree that the case may be arbitrated by a sole arbitrator or the case satisfies the requirements for a sole-arbitrator tribunal under the applicable arbitration rules.
