Preservation of Evidence in International Arbitration in China


A disputing party may file a petition for preservation of evidence to the arbitration commission if he believes that any evidence may be destroyed or become difficult to obtain.

In international arbitration in China, the arbitration commission that receives a petition for preservation of evidence shall refer the petition to the intermediate people's court in the jurisdiction where the evidence is located.

Other provisions pertaining to preservation of property apply, mutatis mutandis, to preservation of evidence.
