Suspension of Enforcement after Providing Security

Suspension of Enforcement after Providing Security

Where a party against whom enforcement is sought provides a security to the people's court in the course of an enforcement action and obtains the consent of the party seeking enforcement, the people's court may make a decision to suspend the enforcement action for a specified time period.

Where a party against whom enforcement is sought fails to perform his obligations within the specified time period, the people's court may choose to enforce the collateral provided by the party against whom enforcement is sought as security or the property of the surety.
